OnlyFans Star Squirrel Daddy Plans Suit Against New York State for Death of Peanut
READ TIME: 3 MIN.
The owners of Peanut the Squirrel, Mark Longo and Daniela Bittner, filed a notice of their intention to make a claim against the government for the death of Peanut and their raccoon, Fred, reports TMZ. The couple allege "unlawful search and seizure, violation of freedom of speech, and other due process violations," reports TMZ.
"Longo and Bittner say the incident was the result of negligence, carelessness, and recklessness by the state of NY and its agents ... saying they may have violated due process laws by not revealing to a judge their intention to kill the animals after raiding Longo and Bittner's home."
Another issue with the raid, the couple claim, is that Peanut and Fred were considered companion animals under the law, not wild animals, a distinction that was never discussed in court before the raid, which Longo and Bittner claim was an oversight by the state.
Mark and Daniela say the two animals were "executed," asserting that since the animals weren't sick they were not "euthanized." Moreover, the pair maintain that they had been pursuing licenses as "Wildlife Rehabilitators," as well as other documentation.
"Since there was no legitimate basis to believe the animals had rabies, Mark and Daniela claim a 10-day quarantine would have been sufficient," TMZ details, "with no need to put the animals down.
"They will sue for emotional distress, pain and suffering, violations of their constitutional rights and lost wages since Peanut's online presence supplemented their income," adds TMZ.
EDGE reported at the time of the raid that Longo was revealed to be an OnlyFans star. The account has been so successful that Longo and his wife were able to buy the farm on which they live from their earnings. The New York Post wrote at the time that Longo also believes it was someone jealous of their OnlyFans success that turned him in. The couple claim their OnlyFans success "may have been enough to drive someone to drop a dime on them – and their fluffy-tailed cash cow."
